The Inspired Brand

Overview

You are engaging The Inspired Brand as an independent contractor to perform work as described in the package(s) or service(s) you have purchased. In the event access to your website is necessary, you hereby authorize The Inspired Brand access and permissions to all directories and files as well as permission to install any necessary WordPress plugins for maintenance and security.

Privacy Policy

By working with The Inspired Brand you agree to the following policies:

Any personal information you provide to us including your name, address, telephone number and email address will not be released, sold, or rented to any outside entities or individuals.

We do not collect credit card numbers and/or payments directly. Credit card payments and refunds are completed through Stripe, E-check, and Wire Transfers.

Miscellaneous

Most projects have a target completion date, which is a range of normal completion time. If you have a firm deadline, please advise us as soon as possible, preferably prior to beginning the project. We are not responsible for “late” or “overdue” projects that have no established deadline or that is due to non or late payment.

Pricing & Payments

All prices appearing on this site are subject to change without notice. Once you engage The Inspired Brand as a branding and website services provider, you authorize The Inspired Brand to charge the payment method you submitted for all the invoices generated for the services requested. All project invoices and payments will be made available to you. In order to cancel any recurring payment or change payment method, simply contact us at hello@theinspiredbrand.com prior to your payment due date.

When you make a purchase on the Website, you will be using a third party payment processor, Stripe, that will collect your payment information and process your payment. We are not responsible for the collection, use, sharing or security of your billing information by Stripe. The following payment method(s) are accepted by the third party payment processor: American Express, Discover, MasterCard, Visa, and E-check.

You hereby represent and warrant that you have the legal right to use the payment method(s) in connection with any purchase and that the information that you supply to us and to the third party payment processor(s) is true, correct and complete.

TERM/TERMINATION

This Agreement shall terminate automatically upon completion by Consultant of the Services required by this Agreement or 1 year from the effective date of this agreement.

We reserve the right to modify or terminate services and the Client-Company relationship at any time for reasons such as, but not limited to, dangerous or criminal behavior on the part of the Client, inappropriate or offensive behavior from the Client, or irresponsible or disrespectful behavior from the Client. The Inspired Brand will notify the Client with the reason for termination or modification and notice that it is effective immediately on the day that we contact the Client about modification or termination. In such situations, at the discretion of The Inspired Brand, a refund may or may not be issued for any remaining sessions or services that were paid for but not completed.

Cancellation & Refunds

Due to the service-based and digital nature of our services, we are unable to provide refunds for most services once payment is submitted. However, we understand and appreciate that life and extenuating circumstances do happen, and are always open and accommodating whenever possible. These are the terms for each of our service areas:

Branding & Web Design Services

Payments for custom design projects are made to us in increments as a courtesy to the client. Once a payment or deposit is made, it is non-refundable. If a project is cancelled or postponed, all monies paid are retained by The Inspired Brand and if applicable, a fee for all work completed beyond what was already paid for shall be paid by the client.

Should either The Inspired Brand or Client elect to terminate this contract, The Inspired Brand reserves the right to collect payment for services provided and will allow Client thirty (30) days to remit payment in the amount disclosed on final invoice that will be provided to Client by The Inspired Brand within fifteen (15) days of contract termination.

In the unlikely event that the Consultant is injured or becomes too ill to perform services, Consultant will make every effort to secure a suitable replacement Consultant. If the situation should occur and a suitable replacement is not found, the active project will be cancelled, and a refund for any unused hours / services will be returned to the client within 30 days of termination notice. If the client does not want the Consultant to find a replacement, the Client may choose to cancel their project, and a refund for any unused hours / services will be returned to the client within 30 days of termination notice.

Strategy, Coaching & Consulting Services

Your purchase of coaching packages or sessions indicates your commitment to participate in the process and follow through to its conclusion. However, we also understand that unexpected events can happen. In addition to the general guidelines outlined below, refunds and cancellations will be considered on an individual basis, at the discretion of The Inspired Brand. We ask the Client to be committed, respectful, and in high integrity. We commit to the same, and to offering grace when needed.

The Client may cancel an order within 24 hours of purchasing and request a refund. The refund will be issued, minus a 5% transaction fee. To cancel an order, send your request to hello@theinspirebrand.com. The Client must clearly state their decision to cancel, the reason for said cancellation, and reimbursement will be made to the original method of payment.

If the Client cancels after beginning sessions and/or receiving services with The Inspired Brand, they may only request a refund for the amount pertaining to remaining sessions or hours not yet logged. The Client will not have the right to cancel or request a refund after the services have been fully performed (after all sessions or services have been completed), or after 30 days from the initial payment.

Digital Templates & Workbooks

Due to the digital nature of our products, and the instant access to materials and bonuses, we are unable to offer refunds for any Template Shop purchases for any reason, which includes in particular partial refunds requested in the context of ongoing payment plans. Our team is more than happy to answer any questions you have prior to your purchase! Just shoot us a note at hello@theinspiredbrand.com.

Live Classes & Workshops:
No refunds are offered for live masterclasses & workshops on the basis that you change your mind or can no longer attend. In the event of a cancellation for any reason on the part of The Inspired Brand, an attempt to reschedule the event must be offered within a reasonable timeframe (90 days), and if not, a refund will be provided for the amount paid in full to your original method of payment.

Recurring Subscriptions & Payment Plans

Cancellation of any monthly recurring service can occur at any time after your first one month (30 days) of service. No Refunds are available after your purchased package or service has been started, unless otherwise specified by any authorized member of The Inspired Brand. A 30-day notice is requested and required to cancel your services and any recurring billing.

The Inspired Brand will delete all off-site backups and third-party services will stop at the end of your paid term upon cancellation or expiration of your account.

Reimbursement for refunds will be provided by the best available method, based on the Client’s situation and at the discretion of The Inspired Brand. A 5% transaction fee of the refund amount will apply and be subtracted from all refunds.

Third Party or Client Page Modification

You acknowledge that you or their staff have access to independently edit or update web pages within WordPress platform. You also acknowledge that anyone other than The Inspired Brand or its subcontractors who attempt to update the website and damages the design or impairs the ability for the web pages to display or function properly, may result in time to repair the web pages in order to restore the website. In this event, damages will be assessed at an hourly rate of $200 per hour with a one-hour minimum. Work to repair the website from third-party modifications is outside of the support time and scope of the ongoing website care.

The Inspired Brand does not assume any responsibility or liability for the content of the websites it manages, maintains and/or hosts.

Refusal of Service

The Inspired Brand reserves the right to refuse service to any individual, website, or blogs that contain offensive, obscene, hateful, malicious content or any other reason.

Limitation of Liability; Disclaimer of Warranties

Although there are limitations to the guarantees we can provide, your satisfaction is very important to us. We strive for your website’s optimal performance and security, we did not build the WordPress software or plugins used on the website, nor the hosting platform it runs on. Please read and understand our limits of liability before ordering services.

You expressly agree that your use of, or inability to use, the functions contained in these webpages or the Internet website is at your sole risk. The functions of the webpages and the Internet website created for you are provided “as is” and “as available” for your use, without warranties of any kind. The entire risk as to the quality and performance of the webpages and website is with client.

The Inspired Brand does not represent, guarantee or warrant that the functions contained in these webpages or internet website will be uninterrupted, error-free, free from loss, corruption, attack, viruses, interference, hacking, or other security intrusions, and The Inspired Brand disclaims any liability relating thereto. To the extent not prohibited by law, in no event will The Inspired Brand be liable to the client or any third party for any damages, including, but not limited to, any lost profits, lost savings, loss of data, business interruption, or incidental, consequential or special damages arising out of the operation of or inability to operate these web pages or website, however caused, even if The Inspired Brand has been advised of the possibility of such damages.

Acceptance

Please note that by submitting your payment, you are agreeing to all of our terms of service as they are written here. The Inspired Brand reserves the right to change or update these terms at any time without prior notice. The user of this site agrees to the terms of this agreement on behalf of his or her organization or business. This Agreement constitutes the entire understanding of the parties. Any changes or modifications thereto must be in writing and signed by both parties.

WordPress Care Plans

AUTHORIZATION

You are engaging The Inspired Brand, as an independent contractor to perform work as described in the package(s) or service(s) you have purchased. In the event access to your website is necessary, you hereby authorizes The Inspired Brand access and “write permissions” to all directories and files of your account with any other third party hosting provider, as well as permission to install any necessary WordPress plugins for maintenance and security.

PRICING & PAYMENTS

All prices appearing on this site are subject to change without notice. Once a client of The Inspired Brand, you authorize The Inspired Brand to charge the payment method you submitted for all the invoices generated for the services rendered by The Inspired Brand. In order to cancel your recurring payment or change payment method, simply contact The Inspired Brand prior to your payment’s due date.

CANCELLATION & REFUNDS

Cancellation of any monthly recurring service can occur at anytime after your first 1 month (30 days) of service. No Refunds are available after your purchased package or service has been started, unless otherwise specified in any communications authorized by The Inspired Brand.

To make a cancellation request, you will need to fill out our cancellation request form. or send us an email to hello@theinspiredbrand.com.

The Inspired Brand will delete all off-site backups and third-party services will stop immediately upon cancellation or expiration of your account.

REFUSAL OF SERVICE

The Inspired Brand reserves the right to refuse service to any individual, website, or blogs that contain offensive, obscene, hateful, malicious content or any other reason.

THIRD PARTY OR CLIENT PAGE MODIFICATION

With a WordPress-based website, client will independently edit or update his or her web pages after completion of the site, unless otherwise agreed upon in this agreement by client and The Inspired Brand. If anyone other than The Inspired Brand or its subcontractors attempts to update the web site and damages the design or impairs the ability for the web pages to display or function properly, time to repair the web pages will be assessed at an hourly rate of $150 per hour. There is a one-hour minimum.
The Inspired Brand highly recommends that you use a child theme. Using the main (“parent”) theme on your website means that updates to that theme will likely return your website back to the default settings. The Inspired Brand will not be held responsible for data lost as a result of a theme update where you haven’t utilized a child theme properly.

LIMITATION OF LIABILITY; DISCLAIMER OF WARRANTIES

The Inspired Brand does not guarantee, represent, or warrant that the functions contained in these webpages or the Internet website will meet the client’s requirements or that the operation of the webpages will be uninterrupted or error-free.

This Work Statement Agreement is governed by the laws of New York without giving effect to its conflict of laws provision. You expressly agree that exclusive jurisdiction for any claim or dispute with The Inspired Brand or relating in any way to your use of the created webpages or Internet website resides in the courts of the State of New York.
